The following statement informs you, which data we collect, and for which purpose we do this, how we protect this data what are your rights and which protection options you have.

The protection of privacy and the costumer's, business partner's and respondent's respect of the privacy rights are essential principles for us.

Therefore, we adhere strictly to the legal requirements for the protection of the personal data and commit ourselves as a market research institute the quality standards of the professional associations (BVM, ADM, ESOMAR), as well as the legal regulations of the European data protection regulation (EU-GDPR) and the federal data protection law new (BDSG new).

2. Collection and use of data

 
2.1 In the main and secondary purpose

The collection, processing or use of data is earmarked for carrying out the business purpose of market and social research within the meaning of Art. 5 para. 1 lit. b EU-GDPR and Article 89 (1) EU-GDPR.

To fulfil the stated purposes, the following persons data is collected, processed and used:

-       Participants in surveys (Personal data such as names and addresses, will only be collected and processed in surveys, if participants disclose them to us at their own request, e.g. to participate in incentive programs or for the purpose of a prize dispatch)

-       Employees
-       Applicants
-       Customers, purchasers, suppliers, service providers
-       Visitors of the conSens website

According to EU-GDPR, concerned persons can contact us free of charge for questions regarding the collection, processing or the use of their personal data.

Personal information that you make within an interview will be treated confidentially and will only be available in an anonymized and aggregated way for our client. Therefore, conclusions on you as a person are excluded. All information, which is given by you, is voluntary.

Your information will solely be used fort he described purpose above for the anonymous, summarized analyse of market research studies. Your data will not be used for advertising purpose. At no time we will disclose contact information about your person or your company to third parties.

The collected data in the survey are recorded in our data processing system and saved for evaluation. Your contact details, if you have communicated them to us, will be saved during the evaluation period for control purposes and deleted after the evaluation.

Secondary purposes are:

-       Personal data management
-       Customer-/purchase data management
-       Applicants data management
-       Supplier and service provider data management

The personal data of the secondary purposes are exclusively used by internal specialist departments for the implementation of the corresponding secondary purposes.

2.2 Processing of children personal data

conSens never collects or processes personal information from children under 16 years without the prior consent of the guardian. If we become aware, that a child's personal information has been collected inadvertently, we will immediately delete the information.

2.3. Data protection in applications and during the application process


We collect and process the applicant's personal data for the purpose of the processing's application process. The processing can also be done electronically. This is particularly the case if an applicant submits corresponding application documents to conSens via e-mail bewerber@consens-forschung.de or via a web form on the website.
If the controller concludes a contract of employment with an applicant, the transmitted data will be saved for the purpose of executing the employment relationship in compliance with the statutory provisions in accordance with § 26 (1) BDSG (new).

If no employment contract is concluded with the applicant by the controller, the application documents will be automatically deleted pursuant to § 15 (4) AGG two months after the notification of the rejection decision, provided that deletion does not conflict with any other legitimate interests of the controller. Other legitimate interest in this sense is, for example, a burden of proof in a procedure under the General Equal Treatment Act (AGG).

If the applicant is interested in future vacancies, he can allow us, according to Art. 6 para. 1 lit. a EU-GDPR, the consent of the storage of applicant data until revocation.
 

3. Use of the conSens website

The use of our websites is basically possible without an indication of personal data. Data is personal if it can be clearly assigned to a specific natural person.

We will not share your information with third parties unless you have expressly consented it or the following exceptions occur.

Exceptions:

Insofar as we are legally obliged to do so or by court order, we will forward your data to public and private authorities entitled to receive information. Furthermore, we reserve the right to transfer your personal data to third parties without your consent, if necessary, in order to defend ourselves against attacks which constitute criminal offenses, or which are likely to impair or cancel the functionality of our website.


3.1 Data transmission through the contact form


You have the possibility to contact us via a contact form on our website. Unless otherwise agreed, we store and use the data entered by you exclusively for processing your request and in the case of follow-up questions. We will not share this information without your consent.

The processing of the data entered in the contact form takes place exclusively on the basis of your consent (Art. 6 para. 1 lit. a EU-GDPR). A revocation of your already given consent is possible at any time. For the revocation is sufficient an informal message by e-mail to datenschutz@consens-forschung.de. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

Data submitted via the contact form will remain with us until you request us to delete it, revoke your consent to storage or there is no longer the need to retain your data. Mandatory statutory provisions - especially retention periods - remain unaffected.


3.2 Use of Cookies

Our website uses cookies. These are small text files that your web browser stores on your device. Cookies help us to make our offer more user-friendly, effective and securer. Some cookies are "session cookies". Such cookies will be deleted automatically after the end of your browser session. On the other hand, other cookies remain on your device until you delete them by yourself. Such cookies help us to recognize you when you return to our website.

With a modern web browser, you can monitor, restrict or prevent the setting of cookies. Many web browsers can be configured to automatically delete cookies when the program is closed. The deactivation of cookies may result a limited functionality of our website.

The setting of cookies, which are necessary for the performance of electronic communication processes or the provision of certain functions desired by you, takes place on the basis of Art. 6 para. 1 lit. f EU-GDPR. As the operator of this website, we have a legitimate interest in the storage of cookies for the technically flawless and smooth provision of our services. If other cookies are set (e.g. for analysis functions), they will be treated separately in this privacy policy.


3.3 Google Maps

In our website, we use Google Maps to represent different areas. Likewise, the Norwegian maps are based on Google Maps. This is a service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereafter just called as "Google."

Google guarantees that EU data protection standards will be respected even when processing data in the US.

In order to enable the representation of certain fonts in our Internet appearance, a connection to the Google server in the USA is set up when calling our Internet appearance.

Insofar as you access the Google Maps component integrated in our website, Google will store a cookie on your device via your Internet browser. To view our location and provide directions, your user settings and data are processed. Here we cannot rule out that Google uses servers in the United States.

The legal basis is Art. 6 para. 1 lit. f EU-GDPR. Our legitimate interest lies in optimizing the functionality of our website. Google's connection to Google enables Google to determine from which website your request has been sent and to which IP address the directions are to be transmitted.

3.4 Link to other websites

Our website contains links to other websites to which this privacy statement does not extend. The each linked external sites have their own privacy policies and procedures that we have no control over. As far as we know about this information, we will attach it here.

  

4. Hosting and automatic data logging when visiting this website

For the technical operation of the website, we use instruction-bound, technical service providers (hosting) based in Germany by means of order data processing.

Every time our website is accessed, data and information are collected automatically by the computer system of the calling computer.

The following data is collected by the provider:

-       Information about the browser type and the used version
-       The user's operating system
-       The user's Internet service provider
-       The user's IP address
-       Date and time of access
-       Websites form which the user's system reaches our website
-       Websites accessed by the user's system through our website
 
A storage of this data together with other personal data of the user does not take place. Likewise, we do not analyse the mentioned above data which are collected in an automated manner.

 

5. Planned data transfer to third countries

There is no intention to transfer personal data to third countries outside the European Union (EU) or the European Economic Area (EEA).
 

6. Organizational and technical safety precautions

We treat your personal data strictly confidentially and in accordance with the statutory data protection regulations and this privacy policy. In accordance with the principles of data avoidance and data economy, personal data will be deleted after expiration of earmarking and according to the statutory deletion periods.

For participants on surveys, is this usually the conclusion of the market research project plus a certain grace period (for example, for questions regarding incentives).

All our employees have been committed to data secrecy. The access rights to internal applications are limited to the immediate needs of the individual functional areas; the access requires individual authentication.

Our safety precautions are state-of-the-art and comply with high, recognized industry standards. Our servers are in Germany and therefore are subject to the strict German standards for data protection and security.
 
For security reasons and to protect the transmission of confidential content (e.g. via the contact form), which you send to us as a site operator, our website uses an SSL respectively TLS encryption. Thus, data that you submit via this website, is not readable for others. You will recognize an encrypted connection at the "https://" address bar of your browser and at the lock icon in the browser bar.

We point out, however, that complete protection against access by third parties in Internet-based data transmission is not possible.
 

7. Right to information, change, cancellation

You can contact us at any time to exercise your right to free information about your stored personal data, their collection, processing and use and data portability. The same applies to your right to rectification, blocking, deletion of your stored personal data or revocation of a given consent. Legal retention periods (for example according to the tax laws) remain unaffected.
